The legislators just passed a bill to help the condo associations and the housing market.: Florida law no longer requires owners to purchase insurance coverage. Associations of condos over 75 Ft. high aren't required to retrofit sprinkler systems. Lenders must pay more of pass due assessments on foreclosed properties. Change from 6 mos to 12 months Associations may deny owners or occupants the use of common areas and recreational amenites when the owner is more than 90 days delinquent in paying financial obigations due to the association. and Associations may divert tenant rents to pay for delinquent assessments owed by unit owners.

Effective Jan 1 the federial government banned the cooling chemical R22 in all new equipment made or imported to the U.S. The new required refrigerant are R-410A and 407C. The new government restrictions on a widely used refrigerant will liking force you to swap out of your entire air condition system. For the remaining year, for a 15 seasonal energy efficiency ratio unit ,the government will cover as much as $1500 credit toward the cost of a new system.

FTC Goes after a Clearwatere Firm

FTC. accused Clearwater based Home Assure LLC.of misleading people trying to avoid foreclosures. The Federial Trade Commission said last week that Home Assure promised borrowers in exchange for fees of up to $2500, but did little or no help. The firm aggreed to repay the consumer $2.4 M. to settle those charges. The company is now barred from selling mortgsge and foreclosure relief services.

Condo Association to Collect Dues From Renters

Under a new law homeowners association boards can go after renters for association fee when the homeowner fails to pay up. The law which took affect July 1, says homeowner associations must notify renters that their payment should be paid directly to the association, not to a landlord who has failed to pay the organization. Before people rent from a homeowner they should seek documents showing that the owner is up to date on their mortgage and association dues.
